— DISPATCH-SERVICE DISCLAIMER
A clear line around every
load.
Effective September 9, 2025
MegaMum Solutions LLC provides administrative dispatch support to authorized motor carriers and owner-operators operating under a motor carrier's authority. This Disclaimer explains the limits of MegaMum's role. It applies to website descriptions, consultations, onboarding, and dispatch-support services, together with the signed client agreement.
MEGAMUM SOLUTIONS
1. MegaMum Is a Dispatch Support Company
MegaMum is not a motor carrier, freight broker, freight forwarder, shipper, insurer, law firm, accounting firm, or factoring company. MegaMum does not transport freight and does not hold itself out to shippers as an independent arranger of transportation. Services are performed only for a specifically appointed carrier under a preexisting written agreement and within the carrier's directions and written authority.
2. Carrier Appointment and Control
The carrier retains control over its operations and makes the final decision whether to accept or reject each load, rate, route, schedule, broker, and term. MegaMum may search for opportunities, communicate with brokers, negotiate within carrier instructions, prepare or transmit paperwork, and perform related administrative tasks as the carrier's disclosed agent. MegaMum does not bind a carrier beyond the authority the carrier granted in writing.
MegaMum does not accept a shipment before a carrier-specific appointment and approval, does not reassign an accepted shipment to another carrier, and does not exercise independent discretion to allocate the same traffic among carriers. When MegaMum supports multiple carriers, searches and communications must remain tied to each carrier's equipment, location, availability, authority, lane preferences, and instructions.
3. No Freight Brokerage or Freight Payment Role
MegaMum works for motor carriers, not for shippers. MegaMum does not solicit freight directly from shippers, become a named party to the transportation contract, collect freight charges, or receive load compensation from a broker, shipper, third-party logistics provider, or factoring company. MegaMum's service fee is paid by the carrier under a written agreement. If a requested activity would require broker, carrier, freight-forwarder, or other operating authority, MegaMum will not perform it unless the required authority is obtained.
4. Carrier Responsibilities
The carrier remains solely responsible for:
Maintaining active and appropriate USDOT and operating authority, registrations, process-agent filings, insurance, permits, licenses, tax accounts, and legal compliance.
Selecting, hiring, qualifying, supervising, paying, and disciplining drivers and other carrier personnel.
Vehicle ownership or leasing, inspections, maintenance, repairs, cargo securement, weight, routing, fuel, tolls, parking, and safe operation.
Hours-of-service compliance, ELD records, drug and alcohol requirements, driver qualification files, accident reporting, safety ratings, and all FMCSA, state, local, and contractual duties.
Reviewing and approving load terms, broker identity and credit, rate confirmations, insurance requirements, commodities, equipment suitability, pickup and delivery requirements, and accessorial procedures.
Bills of lading, proof of delivery, lumper receipts, detention and layover records, claims, invoices, taxes, and preservation of required records.
MegaMum does not supervise driving, control the manner in which transportation is performed, or require a driver to violate law, safety rules, hours-of-service limits, or professional judgment. A carrier or driver must refuse or stop any unsafe or unlawful movement.
5. No Guarantee of Loads, Rates, or Revenue
Load availability, rates, routes, demand, fuel costs, broker credit, market conditions, weather, equipment, driver availability, authority status, and many other factors are outside MegaMum's control. MegaMum does not guarantee a minimum number of loads, a particular rate, weekly gross revenue, profit, mileage, lane, schedule, broker payment, detention, layover, truck-ordered-not-used payment, reimbursement, or business result. Examples, projections, testimonials, and prior results are illustrative and are not promises of future performance.
6. Brokers, Load Boards, and Other Third Parties
Brokers, shippers, receivers, load boards, tracking providers, insurers, factoring companies, banks, and other third parties are independent from MegaMum. MegaMum may assist with verification or communication but does not guarantee their identity, creditworthiness, authority, accuracy, payment, performance, cybersecurity, or conduct. The carrier must perform its own due diligence and make the final decision to work with a third party.
7. Delays, Claims, and Operational Losses
MegaMum is not responsible for cargo loss or damage, theft, accident, bodily injury, property damage, breakdown, missed appointment, delay, rejection, shortage, contamination, fine, citation, regulatory violation, insurance denial, chargeback, broker nonpayment, or other transportation loss caused by the carrier, driver, cargo, equipment, route, weather, broker, shipper, receiver, public authority, platform, or other event outside MegaMum's control. MegaMum's responsibility for its own services, if any, is limited by the signed client agreement and applicable law.
8. Accessorials and Documentation
Detention, layover, lumper, truck-ordered-not-used, and other accessorial payments depend on the broker's or shipper's terms, timely notice, supporting documents, and approval. MegaMum may help submit or follow up on a request but does not guarantee approval or payment. The carrier and driver must promptly provide accurate records and meet all notice deadlines.
9. Technology and Communications
The website, telephone, SMS, email, load boards, tracking tools, portals, and third-party systems may experience outages, delays, inaccurate data, or security events. A carrier must independently monitor active loads, safety, appointments, and time-sensitive instructions and maintain backup contact methods. SMS or email should not be the only method used for an emergency or immediate safety decision.
10. Service Agreement Controls
The signed dispatch-services agreement, limited power of attorney, payment authorization, and carrier-specific instructions define the actual relationship. If this website Disclaimer conflicts with a signed agreement, the signed agreement controls to the extent permitted by law. No website statement expands MegaMum's authority or creates a carrier, broker, employment, partnership, joint-venture, insurance, or fiduciary relationship.
11. Regulatory Classification Depends on Conduct
Federal classification turns on the actual nature and scope of the work, not the label used on a website or contract. MegaMum and each carrier must operate consistently with their written relationship. A disclaimer cannot legalize conduct that requires operating authority or violates law. MegaMum may refuse, suspend, or modify a requested task that could exceed its authority or the carrier's instructions.
